2. TDS Deduction Rate

TDS on Winnings: As per the Indian Income Tax laws, a TDS of 30% is deducted on any winnings exceeding ₹10,000 in a financial year. The deduction is mandatory and is applied at the time of withdrawal or crediting winnings into your account.

3. When TDS is Applicable

TDS is applicable on all game winnings (skill-based or other) where the total winnings exceed ₹10,000 in a single transaction.
TDS is deducted only on the amount that exceeds ₹10,000.

4. TDS Certificate

After TDS is deducted, a TDS certificate (Form 16A) will be issued to you. This certificate can be used for filing your income tax returns and claiming credit for the TDS deducted.

5. How We Deduct TDS

The TDS amount is deducted at the time of withdrawal or credit to your account.
For example, if you win ₹20,000, TDS will be deducted on ₹10,000 (the amount exceeding ₹10,000), resulting in a deduction of ₹3,000 (30% of ₹10,000).

6. TDS Reporting

We will file the TDS return with the Income Tax Department. You can use the TDS certificate to reconcile your tax liabilities when filing your annual tax returns.

7. Compliance

By continuing to use our services, you agree to the terms of this TDS policy and acknowledge that TDS will be deducted as per applicable law.

Applicability of TDS

TDS (Tax Deducted at Source) Policy

52 Cards adheres strictly to the provisions of the Income Tax Act, 1961, concerning Tax Deducted at Source (TDS) on winnings from online gaming. This policy defines the legal framework, obligations, and procedures related to TDS deductions from user winnings to ensure full compliance with statutory tax regulations.

Pay TDS only on Net Winning
Net Winnings = Total withdrawals in a financial year – Total deposits in a financial year – Opening balance at the start of the financial year
TDS will be deducted from the Net Winnings included in the withdrawal amount at the time of withdrawal or at the end of the financial year.
The applicable TDS rate is 30%, and no exemptions or deductions under other provisions of the Income Tax Act apply.
No TDS will be deducted if there are no Net Winnings.
If during the year, there are multiple withdrawals and multiple deposits, Net Winnings will be calculated for the current financial year every time and TDS, if applicable, shall be charged accordingly.
Withdrawal can be made tax-free till respective TDS liability does not exceed the Excess Tax paid (TDS deducted).
Financial year-end balances will be considered as withdrawal for that financial year and TDS will be applicable accordingly.
Prizes other than Cash are subject to 30% TDS payable in advance to 52 Cards.

TDS Deduction and Reporting

The deducted TDS will be remitted to the Government of India in accordance with the prescribed timelines.
Users will be issued Form 16A to facilitate tax filing compliance.
Users must provide a valid PAN (Permanent Account Number) for TDS deductions.
Failure to provide PAN may result in TDS deduction at a higher rate as per applicable tax laws.

Filing and Refund

TDS once debited during the financial year cannot be reversed despite the player ending up with negative cash flow on subsequent games, post deduction.
Users can claim a TDS refund while filing their Income Tax Return (ITR), if applicable.
52 Cards is responsible only for TDS deductions and deposits and does not provide tax advisory services.

7. Withdrawal Restrictions

Withdrawals are subject to the completion of necessary KYC (Know Your Customer) verification.
Withdrawals cannot be processed for unverified accounts.

Fair Play Policy

GST will be deducted at the time of adding cash to the account.

Calculation of GST
